These Terms of Service govern your use of https://besy.fr and purchases from BESY. By accessing the store or placing an order, you agree to these Terms. If you do not agree, please do not use the store.

1. ELIGIBILITY

You must be at least the age of majority in your place of residence, or have permission from a parent or legal guardian, to use this store or place an order.

2. STORE PLATFORM

Our store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products and services. Payment processing and other functions may be provided by Shopify, PayPal, and additional service providers subject to their own terms and privacy practices.

3. PRODUCTS AND PERSONALIZATION

Our personalized jewelry is made according to the options and information submitted with the order, including names, dates, birth flowers, finishes, and engraving text. Customers are responsible for reviewing all personalization details and spelling before completing payment.

Product photographs are intended to represent the item as accurately as possible. Colours and appearance may vary slightly because of screen settings, lighting, and the nature of personalized production.

4. ORDERS

We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including suspected fraud, payment problems, unavailable materials, pricing errors, or an inability to fulfill the selected personalization. If we cancel a paid order, we will refund the amount paid for the cancelled item.

An order confirmation acknowledges receipt of the order but does not guarantee acceptance or production.

5. PRICES, PAYMENTS, AND TAXES

Prices are displayed in U.S. dollars unless otherwise stated. Shipping charges and applicable taxes are shown at checkout. Payment must be successfully authorized before an order can be processed.

Customers are responsible for any charges imposed by their bank, card issuer, payment provider, or local authorities.

6. SHIPPING AND DELIVERY

Production, shipping, tracking, address corrections, and delivery issues are governed by our Shipping Policy. Delivery dates are estimates and are not guaranteed.

7. RETURNS, REPLACEMENTS, AND REFUNDS

Personalized items are generally final sale. Eligibility for cancellation, replacement, or refund is governed by our Return, Replacement and Cancellation Policy and any mandatory rights provided by applicable consumer law.

8. INTELLECTUAL PROPERTY

The BESY name, branding, website design, written content, photographs, graphics, and other original materials on the store are owned by BESY or used with permission. They may not be copied, reproduced, republished, or commercially exploited without prior written authorization.

9. CUSTOMER CONTENT AND FEEDBACK

If you submit a review, photograph, suggestion, or other content, you confirm that you have the right to provide it and that it does not violate another person's rights. You grant BESY a non-exclusive, worldwide, royalty-free licence to use submitted reviews and feedback for operating and promoting the store, subject to applicable law.

10. PROHIBITED CONDUCT

You may not use the store for unlawful, fraudulent, abusive, or harmful activity; attempt to interfere with the store's security or operation; introduce malicious code; scrape the store without permission; or violate the intellectual property, privacy, or other rights of any person.

11. THIRD-PARTY SERVICES AND LINKS

The store may contain links to or integrations with third parties. BESY is not responsible for the content, availability, or independent practices of third-party websites and services. Your use of a third-party service may be governed by that provider's terms.

12. DISCLAIMER

To the maximum extent permitted by law, the store and its content are provided on an as-available basis. We do not guarantee that the store will always be uninterrupted, secure, or free from errors. Nothing in these Terms excludes guarantees or rights that cannot lawfully be excluded.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, BESY will not be liable for indirect, incidental, special, or consequential losses arising from use of the store or purchase of a product. Where liability cannot be excluded, it will be limited only to the extent permitted by law.

14. INDEMNIFICATION

You agree to be responsible for losses or claims resulting from your unlawful misuse of the store or your violation of these Terms, to the extent permitted by applicable law.

15. SEVERABILITY AND WAIVER

If any provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver of that provision.

16. GOVERNING LAW

These Terms are governed by the laws applicable to BESY's business in Algeria, without depriving consumers of mandatory protections available under the law of their place of residence. Any dispute will be handled by a court with lawful jurisdiction.

17. CHANGES

We may update these Terms by posting a revised version with a new Last updated date. Changes apply prospectively unless applicable law requires otherwise.
